Air Products and DuPont joint venture receives ruling in patent invalidity/non-infringement case against Cabot Microelectronics DuPont Air Products NanoMaterials is a joint venture between DuPont (DD) Electronic Technologies and Air Products remains confident in its legal positions following the judge's order denying all summary judgment motions in DA NanoMaterials' patent invalidity/non-infringement lawsuit against Cabot Microelectronics (CCMP) currently under way in the U.S. District Court for the District of Arizona. The judge in the case denied summary judgment motions from both DA NanoMaterials and Cabot, including Cabot's claim that DA NanoMaterials infringed Cabot's tungsten chemical-mechanical planarization (CMP) patents. The Court has ordered the parties to submit pre-trial filings by December 16, 2009. The denial of Cabot's summary judgment motion, coupled with a recent invalidation judgment rendered by Korean governmental authorities invalidating Cabot's tungsten CMP patent in Korea, strengthen DA NanoMaterials' position.
